How does the death penalty work? It's my understanding that the jury first will give a verdict of 1st degree murder and then there'll be a sentencing portion of the trial where the jury can suggest a death penalty or different sentence. The Press is making it sound like they might not come back with a 1st degree murder charge because they don't want to see her put to death. Seems to me that they'll have a say in that and they can very well rule 1st degree murder and no death penalty.
The death penalty is implemented on a state-by-state basis. How they do it in Ohio may well be different from Arizona.
