    Pedro Alvarez

Good times for the Pirates and Scott Boras:

Turns out Pedro Alvarez has not reported to the Pirates yet for a reason - the Players Association filed a grievance on his behalf today. They're saying Alvarez verbally agreed to his $6MM bonus after the midnight deadline on August 15th. Scott Boras informed the Pirates that Alvarez will not sign the contract unless it is renegotiated at a higher number.

The Pirates issued a statement, showing their displeasure with Boras' tactics but expressing confidence the grievance will be dropped. The team also indicates disappointment with Alvarez himself, as he ultimately approved this grievance. In a way, it seems like Boras is taking a stand in general against the idea of the midnight deadline.

Alvarez holding out, on restricted list
Pirates' No. 2 overall pick wants to rework signing bonus
    By Jenifer Langosch / MLB.com

PITTSBURGH -- The summer-long drama surrounding Pedro Alvarez took another sudden twist Wednesday, as the Pirates revealed that the No. 2 overall selection in the June First-Year Player Draft is holding out from reporting to Pittsburgh until he can rework his signing bonus.

As a result, the Pirates have placed Alvarez on the restricted list.

Under Major League Baseball rules, any player that refuses to sign an agreed upon contract and report to an organization can be put on the restricted list. While a player is on the restricted list, he may not sign a contract with or play for another organization.

The former Vanderbilt standout agreed to terms on a $6 million signing bonus with the Pirates in the final minutes before the Aug. 15 midnight deadline to sign players drafted this summer. That figure marked the largest bonus the franchise has doled out to a Draft pick, eclipsing the $4 million signing bonus No. 1 pick Bryan Bullington received in 2002.

However, the Pirates, in a release sent out Wednesday afternoon, said that Alvarez's agent Scott Boras informed management that Alvarez will not sign the contract that was agreed upon Aug. 15. Alvarez and Boras are demanding that the Pirates pay him more than the $6 million that has been agreed upon.

According to the Pirates, Boras is contending that the agreement reached on Aug. 15 was done so after the deadline, therefore, not making his client bound to it. The Pirates emphatically refute that claim.

"This claim was not raised on the evening of the 15th when we informed Mr. Boras that Major League Baseball had confirmed that the contract was submitted in a timely fashion," Pirates president Frank Coonelly said in a statement. "Mr. Boras asserted this claim several days later, after all of the draft signings had become publicized."

MLB.com left a message for Boras at his office in an attempt to get his response to the situation.

Coonelly continued by adding that Alvarez's contractual agreement was not even the last contract submitted to MLB on the evening of the deadline.

"The Pirates are confident that the contract reached with Pedro Alvarez was agreed to and submitted to Major League Baseball in a timely fashion and properly accepted by Major League Baseball," he said. "In fact, the contract between the Kansas City Royals and Eric Hosmer, another Boras client, was submitted to the Office of the Commissioner after our contract with Pedro was submitted.

"Mr. Boras is apparently satisfied with the $6 million bonus that he secured for Mr. Hosmer and has not challenged the validity of that contract," Coonelly continued. "Mr. Boras has been informed that if he pursues a claim that our contract with Pedro was not timely, he puts Eric Hosmer's contract with Kansas City in jeopardy."

According to one source familiar with the dissension, Boras is believed to be asking that the Pirates pay another $200,000 in addition to the agreed upon $6 million. Doing so would ensure that Alvarez joined Buster Posey as the highest paid player in the Draft.

The Giants and Posey, the No. 5 overall selection, agreed to a $6.2 million bonus just moments before the midnight signing deadline. That signing bonus was the highest among the 2008 draft class, just slightly higher than the $6.15 million received by top pick Tim Beckham from Tampa Bay.

Tension and frustration between the Pirates and the Alvarez camp have been increasing all summer. It began when Boras showed little interest in getting his client signed quickly even though the Pirates had expressed a desire to get Alvarez some Minor League playing time this season.

And in recent days, that friction had been even more evident, as management was becoming increasing displeased with Alvarez not reporting to Pittsburgh after the deal was struck.

The 21-year-old Alvarez has yet to undergo his physical, which is typically completed within days of a draftee coming to an agreement with a team. His absence over the last 12 days had also kept him from being introduced publicly in a planned press conference.

Coonelly's release also revealed that the Pirates' initial offer to Alvarez after the June Draft was in fact for a $6 million signing bonus. However, Coonelly said that efforts to sign Alvarez immediately were impeded by Boras' presence.

"The Pirates made several attempts to commence negotiations immediately following the draft and were willing and ready to agree to pay Pedro a $6 million signing bonus from the very outset," Coonelly said. "Predictably, however, Mr. Boras refused to engage in any negotiations at all until shortly before the Aug. 15 deadline and even then an agreement was reached only after Pedro took control of the negotiations."

"Regrettably, we are not surprised that Mr. Boras would attempt to raise a meritless legal claim in an effort to compel us to renegotiate Pedro's contract to one more to his liking," he added. "We are, however, disappointed that Pedro would allow his agent to pursue this claim on his behalf. Pedro showed tremendous fortitude and independent thinking when he agreed to his contract on Aug. 15."

Coonelly's statement reiterated the Pirates' desires to move forward with Alvarez in their organization once all these legal issues are untangled.

"The Office of the Commissioner has assured us that we have a valid contract with Pedro and that it will vigorously defend any claim to the contrary," Coonelly said. "Despite our disappointment, we continue to believe in Pedro Alvarez the person and the baseball player and remain excited to add Pedro to our system. We will sit down with Pedro and his family as soon as Mr. Boras' claim is rejected to chart a new and much more productive start to Pedro's career with the Pittsburgh Pirates."

Alvarez was considered by most to be the top talent in this year's Draft.

Boras is slime. Baseball needs a slotted draft to end this nonsense.

Talent is a nice asset, but it will wane. Integrity will always be present. Time for someone to show a little integrity.

Ah, sorry. Maybe we should merge this with Doug's thread in the minor league forum.

    I don't understand.

If, in fact, the bonus was agreed to after the deadline, then there's no contract, and he goes abck to the draft.

He can't renegotiate a higher bonus and still meet the deadline?????

supposedly MLB approved the deal stating it was completed before the deadline. Boras did not object to the timing until days later ... if it was after the deadline shouldn't Boras have objected on the night of the 15th.

Some guys drafted after Alvarez got as good a deal as Alvarez which is why I assume Boras is POed.

I wish the Pirates would tell Alverez that every day he sits out they will fine him. I just don't how MLB and Alvarez would approve a deal and then Boras says "sit out I will get you .2 more". Its time for Selig to step up and put an end to this.

MLB has to get the agreement of the MLBPA to be able to do that. It's a bargaining chip the MLBPA has not yet decided to put on the table.

    Re: Pedro Alvarez

    statement from the Pirates

"at the Pirates' request, the Office of the Commissioner today placed Pedro Alvarez on Major League Baseball's Restricted List. The Pirates were forced to request that Pedro be placed on the Restricted List because we were informed by his agent, Scott Boras, that Pedro will not sign the contract to which he agreed on August 15. Boras further informed us that Pedro will not report to the Club unless we renegotiate his contract and agree to pay him more than the $6 million signing bonus to which he agreed.

"The Major League Rules provide that a player who refuses to sign a Uniform Player Contract to which he has agreed and report to the signing Club shall, upon a report of the signing Club, be placed on the Restricted List until he signs a contract reflecting the terms to which he has agreed. Such a player may not sign a contract with or play for any other Club. While demanding that we renegotiate his contract and pay Pedro more than the $6 million signing bonus to which Pedro agreed, Mr. Boras has contended that the contract we reached with Pedro was consummated after the Aug. 15 deadline. This claim was not raised on the evening of the 15th when we informed Mr. Boras that Major League Baseball had confirmed that the contract was submitted in a timely fashion. Mr. Boras asserted this claim several days later, after all of the draft signings had become publicized.

This is what some in the press were reporting the day of the draft -- that a "spitting contest" had developed between agents over who would negotiate the biggest contract.

And people wonder why Boras is a PITA to deal with.

Attorneys on the board, can the Bucs sue Boras and/or Alvarez?
