It's a sad commentary on society when a slight bump resulting in no physical harm immediately gets labeled "assault."

Assault? I didn't see anything like that. Doesn't look like a big deal to me. It will probably be forgotten quickly if Morgan and the fan just keep quiet and don't a big deal of it.

It doesn't look like assault to me, but it's still not good. The fan did not reach into the field of play, and he had every right to try for that ball because it was in the stands. For Morgan to push him (I don't think it was assault, still uncalled for though) and then continue yelling and jawing with the guy is absolutely ridiculous.
Not that any of this is surprising from Nyjer Morgan. He's been one of the biggest punks in the game for a few years now. Kudos to the fan for not backing down either.
That's not assault. There was absolutely no intent to harm, nor would anyone have been hurt by that love tap.
Morgan acted like a child, for sure, but that's a weak argument for assault IMHO.

Pretty sure it's not a normal human instinct to sit passively in the line of a fly ball hoping an outfielder reaches out and saves you. No one was helping out any team there. I understand the heat of the moment, but you would think he'd realize the other perspective at some point."Nothing major. Everybody might blow it up a little differently. But just one of those plays where I thought I could have had the ball, and their fans are helping out their team."
I love fans making it hard for the other guys to get fouls though. Always face palm when everyone runs away from the ball and gives them a ton of space. Unless it's a Red going for the ball of course.
Assault is the wrong term, Nyjer committed simple battery.
At common law, simple battery is a misdemeanor. The prosecutor must prove all three elements beyond a reasonable doubt:
an unlawful application of force
to the person of another
resulting in either bodily injury or an offensive touching.
Simple battery may include any form of non-consensual harmful or insulting contact, regardless of the injury caused. Criminal battery requires an intent to inflict an injury on another, as distinguished from a tortious battery.
Thanks. Battery I can agree with. I don't want to blow it out if proportion. Its just the disrespect for the customer that burns me most and Nyjer needs to realize it. Cardinals RF Tyoshi Shinjo once flipped the bird to the moon deck one night when I was sitting there with my kids. I didn't appreciate that either. Maybe I am just over sensitive to players disrespecting fans.
