Will the appeal work for Ben Mauk?
We are getting really close to a decision on Mauk's second attempt for a sixth year. I was just wondering how the folks on RedsZone felt about it. Do you think he will get the extra year? This is from Bill Koch's blog yesterday:

Also, FWIW I worked with a UC football player for a few months. He told me that BK fully expects Mauk back because if he doesn't win the appeal he will file suit against the NCAA. The thinking is the NCAA would rather avoid the suit and let him play the sixth year. Take that at face value because I don't think he would ever file suit against the NCAA, and if he did I don't know that he would have a leg to stand on. We'll see how it works out, but that is what I was told by the player.

Agreed. I've heard interviews with him and it sounds like Ben has though. He truly sounds like he's willing to accept either decision. I wonder how much of this is him, and how much is UC.

Seriously? Mauk has a chance to come back and quarterback a team with a decent shot at playing in a BCS Bowl. Why not exhaust your options and see if you can come back? For a player like Mauk (virtually no shot of ever playing football professionally), there's no harm in taking one more chance.
Its not like he's deliberately attempting to game the system or anything.

Well, its been a while since his last appeal failed, and there is suppose to be another chance for him to plead his case in front of a commitee, however when that is going to take place seems to be the million dollar question. It almost seems like a dead subject. I have a few thoughts.
1. I would think it would be better for both the NCAA and UC if a decision would come down sooner rather than later. From what I understand from a source of mine is that Ben will probably pursue legal action if turned down once again. I don't know what goes into that, or what kind of case he would have, but the thinking is that the NCAA will settle before it goes to court and let him play. I don't know where that thought comes from, but my source seemed to act like both Mauk and BK thought that would be the case. That leads me to my next thought. 2. Could UC be trying to keep this thing under wraps? Maybe they are trying to keep any news of legal action away from the University. I don't know why that would be the case, but it sure has gotten quiet. True, its the middle of the offseason, but this could be big news for the Bearcats. I would think that someone would be asking some questions. They just might not be getting any answers. I would have to believe that by now BK and Mike Thomas have a better idea of what is happening with the case. Maybe I'm the only one who is that interested in this though. I don't find #2 likely if for no other reason than I can't think of any reason for UC to quiet the news. |

Games start in six weeks. There's not much time left for Mauk and UC. It's nearly to the point where Kelly needs to press on without Ben Mauk. As great as it would be for Mauk to get a sixth season, I don't want to see this become a distraction when the team departs for Camp Higher Ground.

I haven't followed this closely, so I'll just speak to the general principles.
If I was on the NCAA committee, since there is already a built-in extra year (five to play four), I'd hand out a sixth only in the most extreme of circumstances. Knowing that the vast majority of true freshmen redshirt anyway, I'd be disinclined to give that year back unless I was convinced that (1) he missed the season *solely* due to injury and (2) he would have seen significant playing time if not for being hurt. Based on some quick reading from 2003 season previews and recaps and such, Mauk was expected to redshirt even before he was injured, and Wake's projected starter and top backup stayed healthy. So it would be difficult to convince me that Mauk's injuries (even if legit) cost him playing time of consequence, enough to justify handing out a sixth-year exception.
