I'm trying to figure out, if ND police is not a public agency, from where do they derive actual police powers? Oh well, this kind of convoluted stuff happens all the time. If it didn't, we'd need a lot fewer lawyers.

Authority is derived from those who agree to it. Public or private, if stock is given to an agency it then has authority.
