Firing Employees who have premarital sex
Re: Firing Employees who have premarital sex
I don't see why it wouldn't be legal (depending on the circumstances; pregnancy complicates it). The general at-will rule is you can fire anyone for any or no reason. There are, of course, exceptions.

I think Dave needs to stay in his lane on this one.

I’d wager we all know what “at-will” means.
The question really begged is “is this an exception?”
Re: Firing Employees who have premarital sex
I don't really see the exception unless it's pregnancy related.
Re: Firing Employees who have premarital sex
By the book, I bet employers are allowed to ban premartial sex. But there's that pesky burden of proof, which must be lawfully acquired.
But how do they prove it? To what extent is an employee's privacy legally allowed to be violated?
Heck, are we declaring women pregnant just by looking at them? Silly perhaps, but what does the law say? And of course being pregnant does not prove one had premartial sex.
Re: Firing Employees who have premarital sex
But the employer doesn't really have to prove it if it's truly at at will employee.

What's next?
Firing for oral sex?
Stop the madness!!
Re: Firing Employees who have premarital sex
Colleges can kick students out for it. If you get caught having pre-marital sex at BYU, you're out. Don't see why a private company would be different than a private school.

No, but if they don’t prove it, and an employee sues them after being terminated, and there’s no proof.....

They don't need proof. The employee has no claim. They're an employee at will. The employer can fire them because they think they had premarital sex. Or because he didn't like the color of the shirt he or she wore on the day of termination.
Re: Firing Employees who have premarital sex
I think if you have sex but are really bad at it you should only get suspended.

I'm wondering what happens when you attempt premarital sex, but the old guy doesn't...*ahem*...rise to the occasion? Do you only get a warning for "attempted sex?"
Re: Firing Employees who have premarital sex
Pretty sure that only happens in marital sex.
