Isn't a balk defined as something that is inconsistent with the pitcher's normal actions on the mound? He can move his leg like that as long as he does it the same every time, I think.

I remember the pitchers throwing over multiple times to try to pick off Maury Wills back in the 60's where the first basemen would smack the tag on him so hard it would leave marks on Will's body to try to wear him down to keep him from running. That doesn't happen anymore.
